General terms for customers of the Training Department of MARIKO GmbH

I- Registration
1. The application must be made in writing by post, fax or email. The applications can also be submitted via our Website:
www.maritime-training.de
Registration is binding. By registering, applicants recognize any „Special Conditions of Participation“, associated with the Training course.
2. For the realization of a course, a minimum number of 8 participants are required, the maximum number of participants per course is limited to 12.
Registrations will be considered in the order of receipt. If an application can not be considered, the applicant will be notified immediately. This applicant will then be automatically placed on a waiting list should a place become available in another course. However the definite inclusion of the applicant in a different course is not guaranteed.
Participants will receive written confirmation of their successful admission into a course along (with further course-specific information). The contract will thereby be completed.
3. Before the start of the course the participant will have submitted all of the required documents in the original format. Applicants will be notified of which documents are required in the acceptance letter to the course.
Users with non-German certificates have to clarify whether their evidence (for their participation in refresher training in Germany) according to MSC/Circ.1030 from 29.05.2002 shall be recognized by their own administrative authorities. Attendees of refresher training will not be eligible to receive German certificates.

-II- Course fees
1. The current course fees are stated in the respective course description and apply per participant, unless otherwise stated.
2. All prices quoted are inclusive of VAT, if applicable.
3. The provider reserves the right to change the course fees for future courses. Contracts already concluded remain unaffected.
4. The course fees include the issue of a certificate at the end of the course, all necessary course materials and a catering allowance for sandwiches, coffee/tea and cold drinks.

-III- Payment modalities
1. The course fees must be paid in full before the start of the course, unless other payment terms have been agreed.
2. Payment can be made by bank transfer, credit card, direct debit or other payment methods offered by the provider.
3. In the event of late payment, the provider is entitled to exclude the participant from participation in the course until payment has been made. Statutory default interest may be claimed.
4. Any bank charges or additional costs for international transfers shall be borne by the customer.
-IV- Cancellation and refund
1. Cancellation of the course registration is possible free of charge up to 30 days before the start of the course.
2. Cancellations after this deadline will incur cancellation fees:
2.1. Cancellation up to 14 days before the start of the course: 50% of the course fee.
2.2. Cancellation less than 14 days before the start of the course: 100 % of the course fee.
3. In the event of cancellation of the course by the participant, no (pro rata) refund of the course fee will be made.
4. If the provider cancels a course, the course fee will be refunded in full. Further claims are excluded.
5. In the event of illness that prevents participation in the course, the participant is obliged to inform the provider immediately and present a medical certificate. On presentation of the medical certificate before the start of the course, a free rebooking to a later date will be offered. Alternatively, the course fee can be refunded minus a processing fee of 5%. Refunds are not possible after the start of the course.

-V- Liability / Damages
MARIKO GmbH is not liable for damages resulting from accidents, damage, loss or theft, nor resulting from consequential damages resulting from the training measures. The only exception would be in the case of gross negligence on the behalf of MARIKO GmbH or assistants. Liability is limited to the amount of the performance-related pay.

-VI- Privacy
The data required for payment processing will be processed in accordance with the provider‘s privacy policy. Further information on this can be found in our privacy policy.

-VII- Major customers
For large customers with more than 25 participants, differing individual rules relating to the exchange rate program, course hours, the course fees, etc. are possible.

-VIII- Confirmation of participation and certificates
Confirmations of participation and certificates will only be issued if the course fee has been paid in full.

-IX- Effectiveness
If any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected.

-X- Jurisdiction
The legal jurisdiction relevant to this is contract is in Leer, Germany.
